EPIT Partner Area – Digital Community EPIT Collaboration Platform Terms

The EPIT Partner Area - Digital Community (the “EPIT Collaboration Platform”) is a space to interact with other partners (and other third parties) and to share knowledge and information. The following terms of use apply to any persons accessing the EPIT Collaboration Platform. “We”, “our” and “us” refer toEducation Partnership Innovation Trust (“EPIT”), and “you” and “yours” refers to you, the individual accessing/using the EPIT Collaboration Platform.

 

In these terms, “content” means any post, submission, or other material which a user makes available on the EPIT Collaboration Platform.

 

Rules of Engagement

All use of the EPIT Collaboration Platform is subject to these EPIT Collaboration PlatformTerms, EPIT’s Privacy Policy, and the Terms of Use (each on the EPIT website)(the “EPIT Policies”). By accessing or using the EPIT Collaboration Platform, you agree to be bound by the EPIT Policies.

 

Anyone that has access to, or use of, the EPIT Collaboration Platform must control and monitor all activity conducted through that person’s account and take reasonable precautions to ensure all login information is secure and confidential.

 

The EPIT Collaboration Platform

In accessing or using the EPIT Collaboration Platform, you must not:

  • (a)           Upload any technology which is harmful or malicious, including but not limited to malware that may unlawfully access data owned by EPIT;
  • (b)           Post any Content on the EPITCollaboration Platform which:
  •                 i.             violates the laws of NewZealand;
  •                ii.             is considered by EPIT (in its sole and absolute discretion) to be abusive, offensive, vulgar, obscene, hateful, racist, threatening, defamatory or fraudulent;
  •                 iii.             includes another person’s personal or private information (without the express written permission of the relevant person);
  •                 iv.             is an advertisement, or otherwise spam; or.
  •                 v.             is content which you do not have the legal right to post;
  • (c)           Allow any unauthorised person to post from your EPIT Collaboration Platform account;
  • (d)           Impersonate a person or entity, or falsely represent yourself to be associated with any entity, person or otherwise;
  • (e)           Permit, induce or encourage any third party to do any of the above.

 

In order to keep our EPIT Collaboration Platform safe and positive, if you witness any of the above in any Content on the EPIT Collaboration Platform, please notify the EPIT team as soon as possible via team@epit.org.nz.

 

If you become aware or have reasonable belief to suspect that there has been unauthorised or illegal access to your account, please notify the EPIT team as soon as possible via team@epit.org.nz


Moderation/Prohibition
 

To ensure a safe, positive and productive environment, EPIT may designate persons to act as moderators of the EPIT Collaboration Platform from time to time (“Moderators”).Without limitation to any other rights of EPIT, EPIT and the Moderators reserve the right to remove and/or alter any user-submitted Content at any time without notice for violation of these EPIT Collaboration Platform Terms or any otherEPIT Policies, or for otherwise being deemed, in the sole and absolute discretion of EPIT or the Moderator, to be inappropriate or unlawful, or for any other reason whatsoever.

 

EPIT further reserves the right to exclude users (whether temporarily or permanently) who violate these EPIT Collaboration Platform Terms.

 

Content Use

As part of your use of the EPIT Collaboration Platform, you will share Content with EPIT and other third parties. You will be given the option to either (i) share theContent exclusively with EPIT for the purposes of meeting EPIT’s evaluation criteria; or (ii) share the Content with both EPIT and other users of the EPITCollaboration Platform. You acknowledge that when you share Content with other users of the EPIT Collaboration Platform, you will be solely responsible for expressing in writing the terms on which such Content may be used with the other users.

 

When you select the option to share Content exclusively with EPIT, EPIT will only share the Content with its employees and agents for the purposes of evaluation. From time to time, EPIT may seek your permission to use such Content submitted exclusively to EPIT for the purpose of marketing EPIT or any other similar purposes.

 

You may not use any other user’s Content without their permission. The conditions of use of any other user’s Content will either (i) be governed by a specific written agreement made between you and the other user; or (ii) be expressly permitted in writing by the poster of the Content when such Content is shared. EPIT will not be liable for any loss or damage arising out of a breach of agreement with respect to another user’s Content.

 

Limitation of Liability 

To the fullest extent permissible by law, EPIT and its officers, employees, agents and contractors will not be liable to you (directly or indirectly, whether that liability arises in contract, tort (including but not limited to negligence),equity, under statute or otherwise) for any loss or damage suffered by you caused by, arising out of or in any way connected with these EPIT CollaborationPlatform or your use of the EPIT Collaboration Platform, and you unconditionally and irrevocably release, discharge and will hold harmless EPIT from all liability and responsibility in respect of the same.

 

General

We may change these terms at any time. Any material revisions to these terms become effective on the date they are published. Continued use of the EPIT CollaborationPlatform constitutes acceptance of any updated terms and it is your sole responsibility to monitor these terms for changes.  

 

Any provision of these terms that is illegal or unenforceable may be severed from these terms to the extent of the illegality and the remaining parts these terms shall continue in force.

 

These Terms are governed by the laws of New Zealand and each party irrevocably and unconditionally submits to the exclusive jurisdiction of the courts of New Zealand.
